Article 2 – GENERAL PROVISIONS RELATING TO THESE GENERAL TERMS
The general terms of sale (the "General Terms of Sale", or the "GTS") apply exclusively to the online sale of products offered by the Operator on the website.
The GTS are made available to customers on the Site where they can be directly consulted and can also be communicated to them upon simple request by any means.
The T&Cs are enforceable against the client who acknowledges, by ticking a box or clicking ON the button provided for this purpose, that they have been informed of and accepted them before placing an order. The validation of the order by its confirmation constitutes the buyer's acceptance of the T&Cs in force on the day of the order, the preservation and reproduction of which are ensured by the Operator.
Article 3 – DESCRIPTION OF PRODUCTS
The Site is an online sales site for non-regulated food products, interior decoration, tableware, candles, and cosmetic products (hereinafter referred to as the "Product(s)") open to any natural or legal person using the Site (the "Client").
The Products presented on the Site each have a description (established by the supplier or accessible on the manufacturer's site via a link found on the Site) mentioning their essential characteristics. The photographs illustrating the products, where applicable, do not constitute a contractual document. The product's user manual, if it is an essential element, is available on the Site or is sent at the latest upon delivery. The Products comply with the provisions of current French law.
The Client remains responsible for the terms and consequences of their access to the Site, particularly via the Internet. This access may involve the payment of fees to technical service providers such as Internet service providers, which remain at their expense. Furthermore, the Client must provide and be fully responsible for the necessary equipment to connect to the Site.
The Client acknowledges having verified that the computer configuration they are using is secure and in working order.
Article 4 – CREATION OF THE CLIENT SPACE
To place an order on the Site, the Client must first create their personal client area. Once created, to access it, the Client must identify themselves using their username and their secret, personal, and confidential password. It is the Client's responsibility not to disclose their username and password in accordance with the provisions of the article PERSONAL DATA of these General Conditions. Each Client agrees to maintain strict confidentiality regarding the data, particularly the username and password, allowing them to access their client area, the Client acknowledging that they are solely responsible for access to the Service via their username and password, unless proven fraud. Each Client also agrees to inform the Operator without delay in the event of loss, diversion, or fraudulent use of their username and/or password.
After creating their personal client area, the Client will receive an email confirming the creation of their client area.
The Client agrees upon registration to :
• provide true, accurate, up-to-date information at the time of entry in the service registration form, and in particular not to use false names or addresses, or names or addresses without being authorised.
• keep the registration data up to date to ensure their true, accurate, and up-to-date nature at all times.
The Client further agrees not to make available or distribute illegal or reprehensible information (such as defamatory information or identity theft) or harmful information (such as viruses). Otherwise, the Operator will be able to suspend or terminate the Client's access to the Site at their exclusive fault.
Article 5 – ORDERS
The Operator strives to ensure optimal availability of its Products. Product offers are valid within the limits of available stock.
If, despite the Operator's best efforts, a Product turns out to be unavailable after the Client's order, the Operator will inform the Client by email as soon as possible, and the Client will have the choice between:
• the delivery of a Product of equivalent quality and price to that originally ordered, or
• the refund of the price of the ordered Product no later than thirty (30) days from the payment of the amounts already paid.
It is agreed that, apart from the refund of the price of the unavailable Product, if this option is requested by the Client, the Operator is not liable for any cancellation compensation, unless the non-performance of the contract is personally attributable to it.
Except for any contrary mention in these General Conditions and without prejudice to the right of withdrawal provided by applicable law, the Client's orders are firm and final.
At the time of placing an order, the Client must select the chosen Products, add them to their basket by indicating the selected Products and the desired quantities. The Client has the option to check the details of their order and its total price, and to return to the previous pages to possibly correct the contents of their basket before validating it.
The Client agrees to read the General Terms and Conditions of Sale in force before accepting them and confirming the terms and any delivery and withdrawal fees prior to payment of their order. The confirmation of the order entails acceptance of the GTC and forms the contract.
A link to these General Terms and Conditions as accepted by the Client will be sent to the Client by email at the time of confirmation of their Order so that they can refer to it.
The contractual information relating to the order (including the order number) will be confirmed by email in due time and no later than at the time of delivery. The Operator strongly advises the Client to print and/or archive this order confirmation on a reliable and durable medium as proof. A digital invoice is made available to the Client in the 'my account' area and sent by email to the Client no later than 10 days after the delivery of their package. The Operator also advises the Client to print and/or archive this invoice on a reliable and durable medium as proof.
Any email that is sent to the Client in connection with an order will be sent to the email address that the Client uses to identify themselves in their client area.
The Operator reserves the right not to validate the Client's order for any legitimate reason, particularly in the event that:
• The Client does not comply with the General Terms and Conditions in force at the time of their order;
• The Client's order history shows that amounts are still owed for previous orders;
• One of the Client's previous orders is the subject of an ongoing dispute;
• The Client has not responded to a request for confirmation of their order that the Operator has sent to them.
The Operator archives the sales contracts for Products in accordance with applicable legislation. By making a request to the following address contact@leshallesprovencales.fr, the Operator will provide the Client with a copy of the contract in question.
Any modification of an order by the Client after confirmation of their order is subject to the agreement of the Operator. To do this, the client must contact the Operator using the contact form.
The information provided by the Client when placing the order (notably name and delivery address) is binding. Thus, the responsibility of the Operator cannot in any way be sought in the event that an error during the order placement prevents or delays delivery.
The Client declares that they have full legal capacity to commit to these General Terms and Conditions.
Registration is open to capable adults and minors provided that they act under the supervision of a parent or guardian holding parental authority. Under no circumstances is registration allowed on behalf of third parties unless validly authorised to represent them (for example, a legal entity). Registration is strictly personal to each Client.
In the event of a breach by the Client of any of the provisions herein, the Operator reserves the right to terminate the account of said Client without notice.
Article 6 – PAYMENT METHODS AND SECURITY
The Client expressly acknowledges that any order placed on the Site is an order with a payment obligation, which requires payment of a price in exchange for the provision of the ordered Product.
In any case, the Operator reserves the right to verify the validity of the payment before the shipment of the order, by any means necessary.
The Operator uses the online payment solution Stripe and PayPal, external payment providers offering payment by credit card.
Orders can be paid for using one of the following payment methods:
• Payment by credit card. Payment is made directly on the secure banking servers of the Operator's bank, the Client's banking details do not pass through the Site. The banking details provided during payment are protected by an SSL (Secure Socket Layer) encryption process. In this way, these details are not accessible to third parties.
• Payment by electronic wallet (PayPal). The Client already has an account with the electronic wallet used by the Operator. The Client can use this account and pay for their order securely without providing their banking details.
The Client's order is recorded and validated as soon as the payment is accepted by the bank.
The Client's account will be debited the corresponding amount only when (i) the details of the credit card used have been verified and (ii) the debit has been accepted by the bank that issued the credit card.
The inability to debit the amounts due will result in the immediate nullity of the sale.
The credit card may be refused if it has expired, if it has reached the maximum spending limit to which the Client is entitled, or if the entered details are incorrect.
As part of the control procedures, the Operator may need to request from the Client all the documents necessary for finalising their order. These documents will not be used for any purposes other than these.
Article 7 – PAYMENT OF THE PRICE
The price of the Products in effect at the time of the order is stated in euros, all taxes included (TTC), excluding delivery and transport costs. In the case of a promotion, the Operator commits to applying the promotional price to any order placed during the period of the advertising made for the promotion.
The price is payable in euros (€) exclusively. The price is due in full after confirmation of the order. The proposed prices include any discounts and rebates that the Operator may grant.
If delivery or transport charges apply, they will be added to the price of the Products and indicated separately before the Client validates the order. The total amount due from the Client and its details are indicated on the order confirmation page.
Article 8 – FORMATION OF THE CONTRACT
The contract between the Operator and the Client is formed at the moment the Client sends the confirmation of their order.
The Client's attention is particularly drawn to the method of acceptance of the order placed on the Site. When the Client places their order, they must confirm it using the "double-click" technique, that is to say, after selecting Products added to the basket, the Client must check and possibly correct the contents of their basket (identification, quantity of selected products, price, terms and delivery charges) before validating it by clicking on "validate my order", then they acknowledge acceptance of these T&Cs before clicking on the "order" button, thereby validating their order after having filled in their bank details. The "double click" serves as an electronic signature and is equivalent to a handwritten signature. It constitutes an irrevocable and unconditional acceptance of the order by the Client.
The archiving of communications, order forms and invoices is ensured by the Operator on a reliable and durable medium in order to constitute a faithful and lasting copy. These communications, order forms and invoices may be produced as proof of the contract. Unless proven otherwise, the data recorded by the Operator on the Internet or by telephone constitutes proof of all transactions carried out between the Operator and its Clients.
The order may be resolved by the Client by registered letter with acknowledgment of receipt or by a written document on another durable medium in the event of:
• delivery of a Product that does not conform to the declared characteristics of the Product;
• delivery exceeding the deadline set in the order form or, in the absence of such a date, within thirty (30) days following the conclusion of the contract, after the Operator has been instructed, under the same conditions and without result, to make the delivery within a reasonable additional time;
• of price increases that are not justified by a technical modification of the product imposed by the public authorities.
In all these cases, the Client may demand a refund of the deposit paid, increased by interest calculated at the legal rate from the date of receipt of the deposit.
The order may be cancelled by the Operator in the event of:
• the buyer's refusal to take delivery;
• non-payment of the price (or the balance of the price) at the time of delivery.
Article 9 – RETENTION OF TITLE
The Operator remains the exclusive owner of the Products ordered on the Site until full payment of the price has been received, including any shipping costs.
Article 10 – SHIPPING AND DELIVERY
The online sales offers presented on the site are reserved for consumers residing in France or, where applicable, in certain member countries of the European Union, and for deliveries in these same geographical areas. Delivery means the transfer to the Client of physical possession or control of the Product.
The Operator offers you different delivery or collection methods depending on the nature of the product: at a collection point and at home.
The shipping costs are those specified at the time of finalising the order and are accepted by the validation of the order.
The Operator undertakes, in accordance with the delivery deadline indicated on the Site for each of the Products, to deliver the Products within a maximum period of thirty (30) days after receipt of the order.
Delivery times are announced in working days on the Site at the time of ordering. These times include the preparation and shipping of the order as well as the time expected by the carrier.
The Operator undertakes to ship the Products in accordance with the times announced on each Product sheet and at the basket level, provided that the payment for the order has not been previously refused.
However, if one or more Products cannot be delivered within the initially announced timeframe, the Operator will send an email informing the Customer of the new delivery date.
The Products will be delivered to the address provided by the Customer at the time of their order. It is therefore the Customer's responsibility to ensure that this address contains no errors. The Operator's liability cannot be engaged if the address provided by the Customer is incorrect, thus preventing or delaying delivery.
Upon delivery, it may be requested to sign a receipt.
No delivery will be made to a post office box.
In the event of a failure to deliver the goods due to the Customer's negligence, shipping costs will not be refunded.
Upon delivery, it is the Customer's responsibility to check that the delivered Products conform to their order and that the package is sealed and undamaged. If this is not the case, the Customer must indicate this on the delivery slip. No claims regarding the quantity or condition of the Product will be accepted if the claim has not been noted on the delivery slip.
Article 11 – RIGHT OF WITHDRAWAL
If a delivered Product does not fully satisfy the Customer, the latter may return it to the Operator. The Customer will have fourteen (30) days to do so from the date of receipt of the order.
In accordance with article L.221-21 of the Consumer Code and in order to implement this right of withdrawal under the conditions of articles L. 221-18 and following of the Consumer Code, the Customer is invited to fill out the contact form available on the “Contact” page and to specify the reason in the subject of their message “withdrawal”.
The Operator will send an acknowledgment of receipt of the Customer's withdrawal request by e-mail. If applicable, the Customer may exercise their right of withdrawal by notifying the following information to the Operator:
• name, geographical address, order number (present on the invoice and order confirmation email), telephone number and email address;
• decision to withdraw by means of an unambiguous statement (for example, a letter sent by post, fax or email as long as these details are available and therefore appear on the standard withdrawal form). The Customer may use the model withdrawal form but this is not mandatory.
Return shipping costs are covered by Les Halles Provençales SAS within 30 days following the date of delivery of the order, except for the categories of products mentioned below.
The exceptions of article L.221-28 of the Consumer Code apply and prevent the exercise of the right of withdrawal, particularly if the order consists of a contract:
• provision of services fully performed before the end of the withdrawal period and whose execution began after the express prior agreement of the consumer and express waiver of their right of withdrawal ;

• provision of goods which, after being delivered and by their nature, are mixed in an inseparable manner with other items ;
• provision of alcoholic beverages whose delivery is delayed beyond thirty (30) days and whose agreed value at the conclusion of the contract depends on fluctuations in the market beyond the control of the professional ;
• maintenance or repair work to be carried out urgently at the consumer's home and expressly requested by them, within the limits of the spare parts and work strictly necessary to respond to the urgency ;
• for the supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery ;
• for the supply of a newspaper, periodical or magazine, except for subscription contracts for these publications ;
• concluded at a public auction ;

• for the supply of digital content not supplied on a tangible medium, the performance of which has begun after the express prior agreement of the consumer and the express waiver of their right of withdrawal.
The returned Product must be in its original packaging, in perfect condition, suitable for resale, unused and with all possible accessories.
In addition to the returned Product, the return package must also contain a letter specifying the exact (name, first name, address) and complete contact details of the Customer as well as the order number and the original purchase invoice.
The Operator will refund the Customer the amount of the Product within fourteen (14) days from the receipt of the Product and all elements allowing the implementation of the Customer's refund. This refund may be made by the same payment method used by the Customer. In this regard, the Customer who paid for their order in the form of vouchers / gift cards may be refunded by vouchers / gift cards at the discretion of the Operator.

Article 13 – INTELLECTUAL PROPERTY AND SITE USAGE LICENSE
The Operator is the sole holder of all elements present on the Site, including but not limited to, all texts, files, animated or non-animated images, photographs, videos, logos, designs, models, software, trademarks, visual identity, databases, site structure, and all other elements of intellectual property and other data or information (hereinafter, the "Elements") that are protected by French and international laws and regulations relating notably to intellectual property.
Consequently, none of the Elements of the Site may in whole or in part be modified, reproduced, copied, duplicated, sold, resold, transmitted, published, communicated, distributed, broadcast, represented, stored, used, rented, or exploited in any other way, whether free of charge or for a fee, by a Client or by a third party, regardless of the means and/or media used, whether known or unknown to date, without the prior express and written permission of the Operator on a case-by-case basis, and the Client is solely responsible for any unauthorized use and/or exploitation.
Furthermore, it is specified that the Operator is not the owner of the content uploaded by the Clients, for which they remain fully responsible and guarantee the Company against any claims in this regard. The Clients grant the Operator a non-exclusive, transferable, sublicensable, free, and worldwide license for the use of the intellectual property content they publish on the Site, for the entire duration of protection of such content.
The Operator reserves the right to take all legal action against those who do not comply with the prohibitions contained in this article.
Article 14 – LIABILITY AND WARRANTY
The Operator cannot be held responsible for the non-performance of the contract due to the Client or as a result of an event classified as force majeure by the competent courts or due to the unforeseeable and insurmountable actions of any third party to these presents.
The Operator cannot be held responsible for the information imported, stored, and/or published on the Site by the Clients. The Operator cannot be held responsible for any information published by a Client on the Site and for any direct or indirect damages that such use may cause to a third party, with the Client who originated the publication remaining solely responsible in this regard.
The Client acknowledges that the characteristics and constraints of the Internet do not allow for the guarantee of the security, availability, and integrity of data transmissions over the Internet. Thus, the Operator does not guarantee that the Site and its services will operate without interruption or operational errors. In particular, their operation may be temporarily interrupted for maintenance, updates, or technical improvements, or to evolve their content and/or presentation.
The Operator cannot be held responsible for the use that may be made of the Site and its services by Clients in violation of these General Conditions and for any direct or indirect damages that such use may cause to a Client or a third party. In particular, the Operator cannot be held responsible for false statements made by a Client and for their behaviour towards third parties. In the event that the Operator's liability is sought due to such behaviour by one of its Clients, the latter agrees to indemnify the Operator against any judgment rendered against it as well as to reimburse the Operator for all costs, including legal fees, incurred for its defence.
The Client is solely responsible for the entirety of the content they upload to the Site, of which they expressly declare to hold all rights, and guarantees to the Operator that they do not upload content that violates third-party rights, particularly intellectual property rights, or constitutes an infringement on individuals (notably defamation, insults, slander, etc.), respect for privacy, an infringement on public order and good morals (notably, glorification of crimes against humanity, incitement to racial hatred, child pornography, etc.). In the event of a breach of applicable laws, good morals, or these General Terms and Conditions, the Operator may exclude by right Clients who have committed such infractions and remove information and references to such contentious content. The Operator is qualified as a host regarding content uploaded by third parties. In this respect, it is reminded that the Operator has no general obligation to monitor the content transmitted or stored via the Site. In the event that the Operator's liability is sought due to content uploaded by the Client, the latter agrees to indemnify the Operator against any judgment rendered against it as well as to reimburse the Operator for all costs, including attorney fees, incurred for its defense.
Regardless of any additional contractual guarantee (commercial guarantee) that may be granted, the Products benefit from the legal guarantee of conformity provided for in articles L. 217-4 and following of the Consumer Code (notably L. 217-4 to L. 217-14 of the Consumer Code), and from the guarantee against hidden defects provided for in articles 1641 to 1649 of the Civil Code.
When you act within the framework of the legal guarantee of conformity:
• you have a period of two (2) years from the delivery of the goods to take action :
• you can choose between repair or replacement of the goods, subject to the cost conditions provided for in article L. 217-9 of the Consumer Code ;
• you are exempt from proving the existence of the lack of conformity of the goods during the twenty-four (24) months following the delivery of the goods (except for second-hand goods).
You may decide to invoke the warranty against hidden defects of the sold item as defined in article 1641 of the Civil Code. In this case, you can choose between the cancellation of the sale or a reduction in the sale price in accordance with article 1644 of the Civil Code.
Reproduction of articles L. 217-4, L. 217-5, L. 217-7, L. 217-9 and L. 217-12 of the Consumer Code, of article 1641, 1644 and the first paragraph of article 1648 of the Civil Code, as in force on the date of these General Conditions :
Art. L.217-4 of the Consumer Code :
« The seller delivers a good that conforms to the contract and is liable for any lack of conformity existing at the time of delivery. They are also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter has been placed at their charge by the contract or has been carried out under their responsibility. »
Art. L.217-5 of the Consumer Code :
« The good is in conformity with the contract :
1° If it is fit for the usual purpose expected of a similar good and, where applicable :
– if it corresponds to the description given by the seller and possesses the qualities that they presented to the buyer in the form of a sample or model ;
– if it has the qualities that a buyer can legitimately expect in light of the public statements made by the seller, by the producer or by their representative, particularly in advertising or labelling ;
2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, made known to the seller and accepted by them. »
Art. L.217-7 of the Consumer Code :
« The defects of conformity that appear within a period of twenty-four months from the delivery of the goods are presumed to exist at the time of delivery, unless proven otherwise.
For second-hand goods, this period is set at six months.
The seller may contest this presumption if it is not compatible with the nature of the goods or the alleged defect of conformity. »
Art. L.217-9 of the Consumer Code :
« In the event of a defect of conformity, the buyer chooses between repair and replacement of the goods. However, the seller may not proceed according to the buyer's choice if that choice entails a cost that is manifestly disproportionate in relation to the other option, taking into account the value of the goods or the significance of the defect. They are then obliged to proceed, unless impossible, according to the option not chosen by the buyer ».
Art. L.217-12 of the Consumer Code :
« The action resulting from the defect of conformity is subject to a two-year limitation period from the delivery of the goods. »
Art. 1641 of the Civil Code :
« The seller is liable for the warranty due to hidden defects in the sold item that render it unfit for the intended use, or that diminish this use to such an extent that the buyer would not have purchased it, or would have paid a lower price, had they known of them. »
Art. 1644 of the civil code :
« In the case of articles 1641 and 1643, the buyer has the choice to return the item and be refunded the price, or to keep the item and be refunded part of the price. »
Art. 1648 paragraph 1 of the civil code :
« The action resulting from redhibitory defects must be brought by the purchaser within a period of two years from the discovery of the defect. »
It is reminded that the search for amicable solutions prior to any potential legal action does not interrupt the time limits for legal warranty actions nor the duration of any potential contractual warranty.
Article 15 – COMMERCIAL WARRANTY
The commercial warranty (contractual commitment of the Operator, in addition to its legal obligations regarding the conformity warranty of the Products) is subject to a written contract in accordance with the provisions of articles L. 217-15 and following of the Commercial Code, of which a copy is provided to the Client.

Consequently, the operator cannot be held responsible in any way for these hypertext links.

The Site may also contain promotional hypertext links and/or advertising banners referring to third-party sites not edited by the operator.
The Operator invites the Client to report any hyperlink present on the Site that would allow access to a third-party site offering content contrary to laws and/or good morals.
The Client may not use and/or insert a hyperlink pointing to the site without the prior written consent of the Operator on a case-by-case basis.
Article 19 – REFERENCES
The Client authorises the Operator to mention the name of the Client, its logo as a reference in its communication materials (brochure, website, business proposal, media relations, press release, press kit, internal communication, etc.).
Article 20 – GENERAL PROVISIONS
INTEGRITY OF THE PARTIES' AGREEMENT
These General Conditions constitute a contract governing the relations between the Client and the Operator. They constitute the entirety of the rights and obligations of the Company and the Operator relating to their subject matter. If one or more provisions of these General Conditions are declared null under a law, regulation, or as a result of a final decision of a competent jurisdiction, the other provisions shall retain their full force and effect. Furthermore, the fact that one of the parties to these General Conditions does not invoke a breach by the other party of any of the provisions of these General Conditions shall not be interpreted as a waiver on its part to invoke such a breach in the future.
AMENDMENTS TO THE CONDITIONS
The Operator reserves the right to modify at any time and without notice the content of the Site or the services available there, and/or to temporarily or permanently cease to operate all or part of the Site.
Furthermore, the Operator reserves the right to modify at any time and without notice the location of the Site on the Internet, as well as these General Terms and Conditions. The Client is therefore required to refer to these General Terms and Conditions before any use of the Site.
The Client acknowledges that the Operator cannot be held responsible in any way towards him or any third party due to these modifications, suspensions or terminations.
